Welcome to the user agreement of GIAROYE
The following terms and conditions apply to your use of the site itself along with all transactions on www.giaroye.com (the website). In return for access to this website, we will impose and require you to accept the terms and conditions of use, set out below. GIAROYE can only supply goods that are ordered online via the website. We do not accept orders by telephone.
You may want to print off a copy for your records and future reference.

New customer
Feel free to browse the website without registering. However, you will need to become a registered customer in order to purchase anything from our website. Becoming a new customer is easy, your username will be a valid email address and you will be asked to choose your own password.
Take care of your username and password, as you will be responsible for all actions taken under that username. So don’t disclose or transfer your username or password to anybody else.
If you think someone is using your details, you should notify us immediately.
By signing up as a customer you undertake that all the information provided is up to date, true and accurate and you will let us know when your details change. You can update your details by emailing us at online@giaroye.com or via the my account section of the website.
Availability and Product Information
All goods displayed on this website are subject to availability, which may change at any time. We ve tried our best to ensure that the product colours displayed are as accurate as possible. However, differences in monitors, means we are unable to guarantee that the colour you will see on your monitor will accurately reflect the true colour of the product.
Pricing and Accepted Currency
All prices shown on this website are in UK sterling and we only accept payments in UK sterling (£GBP). The prices include VAT at 17.5% (current UK VAT tax rate) and are subject to change if the applicable rate of VAT changes before your order is accepted. If you want your goods to be delivered outside of the European Union, you will be responsible for paying any local sales tax or import duties arising at the delivery destination, which are not included in the price of the products.
All currencies will be converted into UK Sterling and you will be liable for any exchange rate charges by your card provider. All prices quoted for goods, exclude the cost of postage and packaging; this will be charged separately at the rates specified in the delivery section below. All prices are as stated on the website. GIAROYE reserve the right to revise the price of goods without notice.
Discount codes may from time to time be offered to account holders; such codes may only be applied to purchases made through the account in respect of which the discount code was offered and registered. Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made through this Website.
These terms and conditions apply to all competitions (unless, and to the extent that, the competition states otherwise). All monthly Giaroye competitions have a closing date, and provide you with the chance to win a number of different prizes with up to £150 pounds worth of Giaroye clothing.
All winners of are competition will be announced at the start of every month E.G. 01/01/2009 and will be notified by e-mail. The winner(s) will be drawn at random from all the entries received before the closing date, which is at the end of every month. If a winner cannot be contacted, or is not available, Giaroye reserves the right to re-draw another winner from the entries which were received before the closing date. All prizes must be claimed within 7 days of being notified, unless otherwise stated. Thereafter the prize claim will be void. Void prizes may be redrawn and offered to another entrant or offered in another prize draw.
Prizes can only be dispatched on confirmation of receipt of notification from the winner, who will be asked to confirm their postal address. Prizes will be sent by default to the customer's registered address. It is the winner's responsibility to notify Giaroye of any change in address.
The winner of the competition will be displayed on the website news letter and blog as title, surname and area they live e.g. Mr Jones from Liverpool. The winner will also be required to send us a photo of themselves wearing there winning prizes. Any images or names supplied will be deemed to have had any copyright ownership transferred to Giaroye and may be used for future promotions.
Entry is limited to one per person and prizes are subject to availability. The winner is responsible for ensuring they are able to accept the prize as set out and in accordance with these terms and conditions, in the event they are unable to do so then Giaroye reserves the right to redraw the prize.
By entering, all eligible entrants agree to abide by each and all these terms and conditions. Misrepresentative or fraudulent entries will invalidate an entry. Giaroye reserves the right, with or without cause, to exclude entrants and withhold prizes for violating any of these terms and conditions. Giaroye reserves the right to amend these terms and conditions. Any amendments will be published on the Website.
Prizes images are merely an indication and may not exactly represent the prize offer. The competition winner can choose any item(s) from the website, up to a value of £150. Items will be valued at their full RRP only. Any sale item(s) which are selected by the winner will only be valued at their full retail price. There is no cash or other alternative to the prize, and no part or parts of the prize may be substituted for other benefits, items or additions.
Giaroye reserves the right at any time to cancel, modify or supersede the competition (including altering prizes) if, in our sole discretion, a competition is not capable of being conducted as specified. Giaroye reserves the right to substitute a prize of equal value in the event that circumstances beyond their control make this unavoidable. The prize draw shall be governed by the laws of England and Wales.
Payment and Security
All payments to GIAROYE are handled securely by PayPal (Internet Service Payment Providers). PayPal accept payment by Mastercard, Visa, Visa Delta, Switch, JCB, Eurocard and Solo (and any other card agreed by them from time to time). Payment for your goods will be debited from your credit or debit card before the goods are dispatched. Upon processing a transaction, PayPal will issue you with an electronic transaction receipt which will be sent by email. All prices are quoted inclusive of 17.5% for UK and exclusive of any postage and packing charges, which will be charged at the rates specified in the delivery section.
Any custom or import duties are charged once the parcel reaches its destination country. These charges must be paid by the recipient of the parcel. Unfortunately we have no control over additional postage charges and local taxes incurred. It might be a good idea to get in contact with your local customs office for current charges before you order, so you are not surprised by any additional charges you were not expecting.
We will confirm our acceptance of your order on receipt of cleared funds by email (where a valid email address is provided).
We reserve the right at all times, and at our sole discretion, to refuse to accept any orders.
We only accept payment by cards via PayPal. Only cards accepted by PayPal can make payments.
All deliveries require a signature; please ensure somebody is home to sign for the goods. If you are not in to receive goods, you can contact the courier company/post office regarding re-delivery/collection. You also have the opportunity to add any special delivery instructions during the ordering process.
All delivery charges are subject to credit card authorisation, customs delays and stock availability.

If we think the delivery of your goods is going to be delayed, we will endeavour to notify you as soon as possible. If the products cannot be delivered within 14 days of your order, we will notify you of this delay and you will have the option to cancel your order or agree a further delivery time with us.
If your order has already been dispatched, don’t worry, just follow the returns procedure and we will grant you a full refund on your purchase only. Please note, the cost of Postage and packaging will not be refunded unless there is a fault with the item purchased.
All delivery times are only estimates and we will not, under any circumstances, be liable for any delay in meeting such delivery times.
If you are not happy with your purchase we will be happy to provide you with a refund, alternatively you can exchange it for something else, providing it is of equal value (subject to availability).
Please note all returned items must be unworn/ unused and returned to us within 14 days of dispatch. All we ask is that you return the goods in their original packaging with their labels in tact. On receipt of the goods you will be issued with a full refund.
We will only refund the cost of postage and packaging if the goods are faulty (this does not affect your statutory rights).
Your custom is important to us and we believe in producing our goods to a high standard. So with each order you will find a returns form. Fill in who you are, whether you want it refunded or exchanged and a brief description for the reason why. Refunds will only be made to the credit or debit card on which the purchase was made.
To return items to GIAROYE please complete the brief "Returns Form" which will be sent out to you with your order. Wrap your item(s) safely and securely to avoid damage in transit back to GIAROYE (please note GIAROYE is unable to accept an item for refund if it has been damaged in transit). It is advisable to obtain a proof of posting certificate if using the Post Office and arrange the necessary compensatory cover for the items.

Business hours are 9:00am to 5.30pm Monday to Friday. We are unable to respond to telephone calls or emails outside of these hours.
Protecting your privacy
We are committed to protecting your privacy and will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for two reasons: firstly, to process your order and secondly to provide you with the best possible service.
The type of information we will collect about you includes: your name, address, phone number, and your email address. We do not collect any credit /debit card information from you expect at the point of sale. Credit/debit card details will not be retained or saved by the site. We will never collect sensitive information about you without your explicit consent. We will use all reasonable endeavours to ensure that the information we hold about you is accurate and up to date.
If you wish, you can check the information that we hold about you at any time by emailing us at online@giaroye.com and asking for details. If you find any inaccuracies, we will either delete the information, or correct it as required.
Warranties
GIAROYE is unable to provide any warranties in relation to goods provided over and above its statutory obligation to provide goods of satisfactory quality in accordance with the Sale of Goods Act 1979 as amended by the Supply of Good and Services Act 1994. This does not affect your statutory rights as a consumer.
Limited Liability
Except in relation to liability for death or personal injury GIAROYE's liability for negligence shall be limited to the total value of the transaction. GIAROYE shall not be liable for any indirect, consequential or special losses even if GIAROYE has previously been advised of the likelihood of such losses.
Availability of Website
Although we will endeavour to ensure that this Website does not have any problems and that the goods displayed are available, we cannot guarantee the availability of the Website, or that any goods on the Website are in stock, or available.
Intellectual Property Rights
The rights in the designs and the content of this Website are owned by GIAROYE. They are protected by copyright and other intellectual property rights. You may not copy, reproduce, modify, distribute or display any part of this site without permission.
All trademarks, product names and company names or logos featured on the Website are the property of their owners.
Right to Alter Terms and Conditions
We reserve the right to alter these terms and conditions without notice from time to time.
Governing Law
These terms of use are governed by and construed in accordance with English law and you agree that the English courts will have exclusive jurisdiction for any dispute under this agreement. The laws of your country may be different from English law and there may be additional legal requirements for you to use our website or services. You must comply with all applicable local and international laws, statutes, ordinances and regulations regarding your use of our website and services. We cannot monitor the laws of every country and it is your responsibility to ensure that your use of our website and services is legal.
